OMVIC continues to see some instances of wholesale dealers engaging in export activities that are not permitted under their class. To remain compliant, you must ensure your registration is in the correct class.
Wholesalers involved in exporting must hold dual registration under the wholesaler/exporter class, which authorizes both wholesale sales and exports, or be registered as a general dealer.
Action Required:
- Review your current registration status immediately.
- If you export vehicles, submit an application for a class change without delay.
Failure to comply may result in administrative or enforcement action.
Permissible Activities with Dual Registration
Dealers with dual registration are authorized to conduct activities under both the wholesaler and exporter classes, as they have met the requirements for each. This provides greater operational flexibility; however, dealers must continue to follow all rules and restrictions that apply to each class individually.
Allowed Transactions:
- Exporters: Can buy but cannot sell to the public within Ontario.
- Wholesalers: Cannot buy and cannot sell to the public in Ontario.
- Dual class (Exporter + Wholesaler): Can buy but cannot sell to the public in Ontario.
Transaction Fees:
- Fees may apply for individuals or businesses who do not have equivalent dealer status.
Premises Requirements:
- Exporter: Must operate from a commercial business location.
- Dual-Class Restriction: Must operate from a commercial business location.
OMVIC encourages all wholesalers involved in export trading to take a moment to confirm that they are properly registered.
