When selling extended warranty, dealers are required to ensure they comply with all requirements under the MVDA. Dealers can only sell extended warranty products that are secured or insured.
Dealers must only sell extended warranties that are properly secured, either insured by a licensed insurance company or supported by a letter of credit submitted to OMVIC.
Dealers are required to provide consumers with clear and accurate information about every warranty sold, including coverage details, duration, responsibility for repairs, and any limitations or exclusions.
If a warranty provider becomes insolvent or ceases operating, the dealer is fully responsible for covering all valid claims.
Warranty and service plan contracts must include all mandatory disclosures, be signed by both parties, and a copy must be provided to the buyer immediately. Dealers must also send all related documents and payments to the warranty provider within 30 days of the sale.
Selling warranties from providers that are not insured and do not have a letter of credit with OMVIC is a compliance violation and may lead to regulatory action. Dealers should use the list below or contact OMVIC’s Industry Standards & Conduct Department at 1-800-943-6002, to confirm whether a warranty company has provided a letter of credit to OMVIC.
